1. Acceptance of these Terms

These Terms of Use ("Terms") are a binding agreement between you and Fast Aperture Enterprises LLC ("Fast Aperture," "we," "us") governing your use of the Fleeced mobile application, the fleecedapp.com website, and related services (together, the "Service").

By downloading, installing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Apple Standard EULA. If you obtained Fleeced from the Apple App Store, your license to use the app is also governed by Apple's Licensed Application End User License Agreement, available at apple.com/legal/internet-services/itunes/dev/stdeula. Where these Terms conflict with that agreement, the Apple Standard EULA controls for the licensed application itself.

2. Eligibility and your account

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Service. If you are under 18, you may use the Service only with the involvement of a parent or legal guardian.

You sign in through a third-party provider such as Apple or Google. You are responsible for maintaining the security of that account and for all activity that occurs under it. Notify us promptly at the address in Section 16 if you believe your account has been accessed without your authorization.

3. What Fleeced does — and doesn't do

Fleeced uses automated and AI-assisted analysis to review bills, estimates, and invoices you submit, and to produce an assessment of whether the charges appear typical, questionable, or high, along with suggested questions you may wish to ask.

Fleeced is an informational tool only. It is not, and must not be relied upon as, legal, financial, accounting, tax, engineering, medical, or other professional advice, and it does not create any professional relationship between you and Fast Aperture.

• Price ranges are estimates. They may not reflect your local market, the specific parts or labor involved, warranty or code requirements, emergency or after-hours rates, or the particular facts of your job.
• Automated analysis can misread a document, miss a line item, or reach an incorrect conclusion.
• A verdict from Fleeced is not a determination that any business has acted improperly, unlawfully, or in bad faith, and should not be presented as one.
• You are solely responsible for verifying information and for any decision you make, or action you take, based on it. Consult a qualified professional before making an important decision.

4. Subscriptions, pricing, and auto-renewal

Scanning a document is free. Unlocking a full report requires a purchase. Fleeced currently offers:

• One report — $4.99 USD, one-time purchase. Non-renewing. Unlocks a single report.
• Fleeced Monthly — $7.99 USD per month. Auto-renewable subscription. Unlimited checks.
• Fleeced Annual — $49.99 USD per year. Auto-renewable subscription. Unlimited checks.

Prices are in U.S. dollars and may vary by country or region; the price shown in the app at the time of purchase governs. Prices are subject to change, and we will give notice of any change to a renewing subscription as required by the applicable app store and by law.

Auto-renewal. Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions renew automatically at the then-current price unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period. Purchases and subscriptions are processed by Apple; we do not receive or store your payment card details.

5. Cancellation and refunds

You can manage or cancel a subscription at any time in Settings → your name → Subscriptions on your device, or at apps.apple.com/account/subscriptions. Cancellation takes effect at the end of the current billing period; you keep access until then. Deleting the app does not cancel a subscription.

Because purchases are processed by Apple, refunds are handled by Apple under its policies. Requests can be made at reportaproblem.apple.com. We cannot issue refunds for App Store purchases directly, but we're happy to help — contact us at the address in Section 16.

6. Your content and our license to use it

You retain all rights in the documents, photographs, and other material you submit ("Your Content"). You grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, process, and transmit Your Content solely to operate the Service and deliver the analysis you requested — including transmitting it to our processing providers for that purpose.

We do not sell Your Content, and we do not use Your Content to train AI models. This license ends when you delete the content or your account, subject to limited retention described in our Privacy Policy.

You represent that you have the right to submit Your Content and that doing so does not violate any law or any third party's rights. Do not upload documents you are not permitted to share.

7. Acceptable use

You agree not to:

• Use the Service to harass, defame, or make unsubstantiated public accusations against any person or business;
• Reverse engineer, decompile, scrape, or attempt to derive the source code or models behind the Service;
• Interfere with, overload, or circumvent any security, rate limit, or access control;
• Resell, sublicense, or commercially redistribute reports or Service output without our written permission;
• Upload malicious code or content that is unlawful, infringing, or that you lack the right to submit;
• Use the Service in violation of any applicable law or regulation.

8. Intellectual property

The Service — including the Fleeced name, logo, interface, design, text, and underlying software — is owned by Fast Aperture Enterprises LLC and protected by intellectual property laws. We grant you a personal, limited, non-transferable, non-exclusive, revocable license to use the Service for your own non-commercial purposes, subject to these Terms. No other rights are granted.

9. Third-party services

The Service relies on third-party providers for authentication, hosting, payment processing, and AI analysis. Your use of those providers may be subject to their own terms. We are not responsible for the acts, omissions, or availability of third-party services, and outages or errors at a provider may affect the Service.

10. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY ANALYSIS, PRICE RANGE, OR VERDICT WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR YOUR SITUATION.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FAST APERTURE ENTERPRISES LLC AND ITS OWNERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE — INCLUDING ANY DECISION YOU MAKE, PAYMENT YOU WITHHOLD OR MAKE, OR DISPUTE YOU ENTER BASED ON A FLEECED REPORT.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY U.S. DOLLARS ($50).

Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

12. Indemnification

You agree to indemnify and hold harmless Fast Aperture Enterprises LLC from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of Your Content, your use of the Service, your violation of these Terms, or your violation of any law or third-party right.

13. Termination

You may stop using the Service at any time and may delete your account in Settings → Delete account. We may suspend or terminate your access if you materially breach these Terms, if required by law, or if continuing to provide the Service to you would create risk for us or other users. Sections 6 through 14 survive termination.

14. Governing law and disputes

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules. You and Fast Aperture agree that any dispute will be brought exclusively in the state or federal courts located in Palm Beach County, Florida, and you consent to personal jurisdiction there. Nothing prevents either party from seeking relief in small claims court. This provision does not deprive you of any protection afforded by the mandatory law of your country of residence.

15. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the Effective Date above and, where the change is material, provide notice in the app or by email. Your continued use of the Service after the change takes effect means you accept the updated Terms.
